This Agreement of Standard Terms and Conditions (the “Agreement”) and the applicable registration or order form (the “Product Form”) for one or more of the products set forth the terms of the relationship between BabyFaces.com Inc. ("BabyFaces"), and you as the purchaser or consumer (“you”) as it relates to the Programs noted above. You and BabyFaces.com may be referred to in this Agreement collectively as “Parties” or individually as “Party.” By participating in one or more Programs you signify that you agree to the terms of this Agreement.

Terms of Use are presented below. If you visit or shop at www.BabyFaces.com .com or any of the affiliate websites, you accept these conditions.

Start your free trial or payment plan of your BabyFaces.com product. If you decide to keep the product, you will be billed a discounted price and enrolled into payment plans. Customer is responsible for return shipping and handling charges.

BabyFaces.com grants you a personal, limited, non-exclusive and revocable license to access and make personal use of this site. If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. glow does sell products for children, but it sells them to adults, who can purchase with a credit card. If you are under 18, you may use glow only with involvement of a parent or guardian. BabyFaces.com and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at their sole discretion.

Governing Law
By visiting BabyFaces.com websites, you agree that the laws of the State of Missouri, USA, without regard to principles of conflict of laws, shall govern these Terms of Use and any dispute of any kind that may arise between you and BabyFaces.com .

Disputes
Any dispute relating in any way to your visit to BabyFaces.com or to products you purchase through BabyFaces.com shall be submitted to confidential arbitration in St. Louis, Missouri, except that, to the extent you have in any manner violated or threatened to violate BabyFaces.com 's intellectual property rights, BabyFaces.com may seek injunctive or other appropriate relief in any State or federal court in the State of California, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Payments for Product or Program. In consideration of the products and services provided as part of the Product, you agree to pay BabyFaces.com the applicable amount(s) as described on the Product for the payment Program. The Program must be paid for in full before any products, services or other benefits of the Program will be provided to you, including sending materials, attendance at in-person events, and/or scheduling or holding coaching sessions. In addition, if you deviate from any payment terms that may be agreed to by the Parties after the commencement of the Program, all Program products and services will be suspended until payment is made. But suspension of Program products and services does not release you from responsibility for fulfilling all payment obligations.

Intellectual Property. You recognize and acknowledge that the trademarks, service marks, trade names, logos, patents and copyrighted materials (the “BabyFaces.com Intellectual Property”) associated with the Programs and their associated websites are proprietary to BabyFaces.com and its affiliated entities. You will not take any action that would interfere or infringe upon the BabyFaces.com Intellectual Property, including, but not limited to: (i) duplication or creation of works (including any derivative works) that are the same or substantially similar to the BabyFaces.com Intellectual Property; (ii) registration, creation or use of trademarks, service marks or domain names that are the same or substantially similar to the BabyFaces.com Intellectual Property; (iii) use, manufacture, import, or sales of any product or service that infringes upon the BabyFaces.com Inc. Intellectual Property; and (iv) any action that would pass off or create the appearance of an association with or endorsement by BabyFaces.com .

Indemnification. You will indemnify and defend BabyFaces.com (as well as its members, employees, instructors, vendors, independent contractors and affiliated entities) from and against any and all claims, expenses, costs, causes of action and damages (including reasonable attorney’s fees) resulting from or arising out of your actions or failure to take action in violation of this Agreement or applicable law.

Modification and Severability of Terms of Use
We reserve the right to make changes to our site, policies, and these Terms of Use at any time. If any of these terms shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
